Terms of Service

1. Acceptance of Terms

By accessing or using DeepDive Trivia at www.deepdivetrivia.com (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Lysara Productions ("we", "us", or "our").

2. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

To access certain features of the Service, you must create an account via Manus OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use automated tools, bots, scrapers, or scripts to access or interact with the Service without our prior written consent.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Circumvent or attempt to circumvent any security or access-control measures.
• Submit false, misleading, or fraudulent information, including in Oracle's Trial predictions.
• Harass, threaten, or harm other users.
• Upload or transmit any content that is unlawful, defamatory, obscene, or infringes any third-party intellectual property rights.
• Use the Service in any way that could damage, disable, overburden, or impair our servers or networks.

5. Pro Subscription

DeepDive Trivia offers a Pro subscription tier at $4.99 USD per month, billed monthly through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period and you will retain Pro access until that date.

All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new price.

6. Curiosity Coins and Virtual Currency

Curiosity Coins are a virtual in-game currency that can be earned through gameplay. Curiosity Coins have no monetary value, cannot be purchased, cannot be transferred between accounts, and cannot be redeemed for real money or any real-world goods or services. We reserve the right to modify, suspend, or terminate the Curiosity Coins system at any time without liability to you.

7. Oracle's Trial — Forecasting Disclaimer

Oracle's Trial is an educational forecasting game designed to improve probabilistic thinking. It is not a gambling service, prediction market, or financial product. No real money is wagered, won, or lost. Prophet Scores and Brier Scores are educational metrics only and carry no monetary value. We do not guarantee the accuracy of any question, outcome, or resolution.

8. Intellectual Property

All content on the Service — including but not limited to text, graphics, logos, game mechanics, software, and the DeepDive Trivia brand — is owned by or licensed to Lysara Productions and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written permission.

By submitting any content to the Service (for example, display names or user-generated content), you grant Lysara Productions a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display that content in connection with operating the Service.

9. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Google AdSense (advertising), Manus (authentication and hosting), and Wikipedia (content). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service providers.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE TRIVIA CONTENT, NEWS SUMMARIES, AND ORACLE QUESTIONS ARE PROVIDED FOR EDUCATIONAL AND ENTERTAINMENT PURPOSES ONLY AND MAY CONTAIN INACCURACIES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LYSARA PRODUCTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lysara Productions and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Sections 8, 10, 11, 12, and 14 of these Terms will survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

15. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or by a prominent notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
